Marriage & Fiance Visas

Our firm can help couples who are engaged or married with one partner living outside of the U.S. obtain either a marriage or a fiance visa. They do have some slight differences, so you’ll want to be aware of them before taking the first steps toward either. 

A fiance visa, or K-1 visa, is a temporary non-immigrant visa. It is petitioned by the partner who is a U.S. citizen using Form I-129F to allow the foreign partner to travel to America with the intent to get married. Once the couple is united in the U.S., they will need to be married within 90 days to remain in the country legally. After the marriage takes place, the individual can apply for a green card and become a lawful permanent resident. This is the ideal option if your fiance’s country will not legally allow the marriage, or you want a faster process of obtaining residency status in comparison to a marriage visa. 

On the other hand, a marriage visa – which is the common name for CR-1/IR01 or K-3 visas – is an immigrant visa, also known as a green card. It is obtained by the foreign spouse following the marriage while they still reside in their home country, for the purpose of legally immigrating to the U.S. with a green card. This is the ideal option if you are a lawful permanent resident (LPR) and also want your spouse to become an LPR, or if the foreign spouse needs to travel abroad after entering the country.
